King\u2019s Counsel. The type you bring in when the fire\u2019s not just at your door but halfway down the hallway. When Cummins Ltd needed to extinguish a public claim from a disabled litigant with an X account, Miller was drafted in \u2013 surgical, sharp, manipulative and confident she\u2019d handle it. And, initially, she did.<\/p>\n\n\n\n<p>The case closed. Quietly. No noise. No headlines. No loss of face for Cummins.<br>She delivered. And then she doubled down.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading has-medium-font-size\"><strong>A New Client, A Familiar Opponent<\/strong><\/h1>\n\n\n\n<p>Months later, in a twist so on-the-nose it reads like satire, another company \u2013&nbsp;<strong>Cepac Ltd<\/strong>&nbsp;\u2013 facing a similar claim \u2013 disability discrimination \u2013 though this time in recruitment, turned to Miller after learning through medical files of their opponents tribunal history. The opposing party? Same guy. Similar allegations. This time, the claim was more layered. More pointed. It alleged not just discrimination but also judicial bias and procedural unfairness.<\/p>\n\n\n\n<p>And Wendy Miller, now holding the pen for Cepac, began writing her next chapter in this increasingly tangled saga.<\/p>\n\n\n\n<p>But something felt off.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>The Lawyer With Two Masks<\/strong><\/h2>\n\n\n\n<p>At the Employment Tribunal, everything is about strategy: posture, timing, and narrative. So when Cummins was suddenly being offered a path to resolution \u2013&nbsp;<strong>a private, confidential settlement opportunity<\/strong>&nbsp;\u2013 what followed didn\u2019t track.<\/p>\n\n\n\n<p>Jiten Kotecha, the polite, reserved and cautious solicitor acting for Cummins, rejected it outright.<\/p>\n\n\n\n<p>No negotiation. No conversation. Just a clipped dismissal. His second curt rejection.<\/p>\n\n\n\n<p>For a multinational under fire, staring down reputational damage from&nbsp;<strong>Apple\u2019s passive observance<\/strong>, and being shredded across social media and a newly formed blog, it was a surprisingly flat response.<\/p>\n\n\n\n<p>So what changed?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Who Gains From Keeping the Fight Alive?<\/strong><\/h2>\n\n\n\n<p>The truth may lie not with Jiten, but behind him. With the hand not seen, but felt.<\/p>\n\n\n\n<p>Settling with the claimant wouldn\u2019t just silence a persistent critic \u2013 it would&nbsp;<strong>risk undermining the optics of Miller\u2019s win<\/strong>&nbsp;in the first case. Worse, it could cast doubt on the legitimacy of her second one. A settlement is a concession. Even if silent. Even if sealed. And&nbsp;<strong>that\u2019s not a headline Miller can afford<\/strong>&nbsp;\u2013 not while she\u2019s still in the trenches for Cepac, against the same disabled low-hanging fruit she seemingly revelled in having a second bite at.<\/p>\n\n\n\n<p>Because if Cummins folds, what happens to the \u201cnothing to admit, nothing to fix\u201d stance she\u2019s built for Cepac?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>An Ethical Tangle<\/strong><\/h2>\n\n\n\n<p>It\u2019s easy to say this is just strategy. That lawyers operate on both sides of a chessboard all the time. But this isn\u2019t chess. This is real life.&nbsp;<strong>Real people. Real reputations. Real consequences.<\/strong><\/p>\n\n\n\n<p>Dual representation isn\u2019t just a logistical risk. It\u2019s a&nbsp;<strong>conflict of interest masquerading as convenience<\/strong>. Because how can any barrister argue vehemently that a claimant is vexatious and wrong\u2026 only to have their former client privately agree to settle?<\/p>\n\n\n\n<p>The contradiction is fatal.<\/p>\n\n\n\n<p>Worse, it raises the headline question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>Who does Wendy Miller KC really represent?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p>Cummins?
